TERMS OF SERVICE for Today’s Wish

Welcome to Today’s Wish. These Terms of Service ("Terms") are a legal agreement between you and Today’s Wish, LLC ("we," "us," or "our"), a Colorado Limited Liability Company. By downloading or using the Today’s Wish mobile application (the "App"), you agree to be bound by these Terms.

1ELIGIBILITY

By using this App, you represent that you are at least 13 years of age. If you are under 18, you represent that you have the consent of a parent or legal guardian to use this App.

2USER ACCOUNTS & SECURITY

To use certain features, you must provide a name, email address, and phone number. You are responsible for:

Maintaining the confidentiality of your account.

All activities that occur under your account.

Notifying us immediately at hello@todayswish.app of any unauthorized use.

3USER CONTENT & CONDUCT

The App allows you to input "wishes" and share them with others.

Your Responsibility: You are solely responsible for the content of the wishes you post.

Prohibited Content: You agree not to post any content that is illegal, threatening, defamatory, harassing, hateful, discriminatory, infringing on intellectual property, obscene, or sexually explicit.

4USER-GENERATED CONTENT (UGC) SAFETY & MODERATION

To ensure a safe environment for all users, Today’s Wish enforces a zero-tolerance policy for objectionable content or abusive behavior.

Reporting Violations: Because content is shared directly via personal communication channels, users can report any inappropriate wishes, intellectual property issues, or abusive conduct directly to our moderation team by emailing hello@todayswish.app.

Our Right to Action: Today’s Wish, LLC reserves the right to investigate all reports, remove content that violates these Terms, and terminate or ban offending user accounts.

5LICENSE TO YOUR CONTENT

You retain ownership of your wishes. However, by putting them into the App, you grant Today’s Wish, LLC a worldwide, non-exclusive, royalty-free license to store, display, and share that content as directed by your use of the App's sharing features.

6INTELLECTUAL PROPERTY

The App's design, code, branding, and the name "Today’s Wish" are the exclusive property of Today’s Wish, LLC. You may not copy, modify, or reverse-engineer any part of the App.

7LIMITATION OF LIABILITY

Today’s Wish, LLC provides the App "as is." To the maximum extent permitted by law, we shall not be liable for:

Any indirect, incidental, or consequential damages.

The loss of any data or "wishes" stored in the App.

The conduct of other users you choose to share your wishes with.

Any technical malfunctions or "downtime" of the service.

8TERMINATION

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business interests of Today’s Wish, LLC.

9GOVERNING LAW

These Terms are governed by the laws of the State of Colorado. Any disputes arising from these Terms shall be resolved in the courts located in Colorado.
